Terms of Use

Clear Terms for Using Website and Services.

These Terms of Use ("Terms") govern your access to and use of the Darul Islah website, digital platforms, forms, communications, and related services. The website and services are operated by LegalLords LLP through its initiative, Darul Islah ("Darul Islah", "we", "us", or "our").
By accessing this website, submitting an enquiry or case, making a payment, registering for a service, booking an appointment, or otherwise using our website or services, you acknowledge that you have read, understood, and agreed to these Terms to the extent applicable to your use.
These Terms should be read together with our "How We Work" page and, where applicable, the specific engagement, quotation, consent, retainer, mediation agreement, arbitration agreement, or other service-specific document applicable to your matter.

About These Terms
These Terms establish the general legal framework governing use of the Darul Islah website and the contractual relationship arising from website-based transactions and service requests, where applicable.
The "How We Work" page explains our service framework, professional roles, responsibilities, engagement practices, fees, confidentiality, accountability, and other operational matters. Those provisions form part of the overall framework governing our services and should be read together with these Terms.
Where a specific written agreement or service-specific document contains terms that expressly govern a particular matter, that document shall prevail to the extent of any inconsistency with these general Terms.

Acceptance and Electronic Contracting
You may accept these Terms electronically by using the website, submitting a form that refers to these Terms, confirming a service, making a payment, clicking an acceptance button, or otherwise demonstrating acceptance through electronic means.
Where applicable, electronic records, communications, acknowledgements, and acceptances may constitute valid evidence of agreement between the parties. Indian law recognises contracts formed through electronic means and gives legal recognition to electronic records in accordance with applicable statutory requirements.
You are responsible for ensuring that any person using the website or making a transaction on your behalf has the necessary authority to do so.

No Professional Relationship Merely by Website Access
Accessing the website, reading its contents, downloading material, sending an unsolicited communication, or submitting a preliminary enquiry does not by itself create an advocate-client, counsellor-client, mediator-participant, arbitrator-party, Mufti-client, consultant-client, or any other professional relationship.
A professional or contractual relationship arises only when the relevant service is accepted and the applicable engagement or arrangement is established.
No person should rely upon general website content as a substitute for individual legal, psychological, professional, or Islamic advice.

Information on the Website
We endeavour to keep the information published on the website accurate, useful, and current. However, website content may be general in nature, may not address the circumstances of a particular person, and may become outdated as laws, regulations, procedures, professional standards, or circumstances change.
Nothing on the website constitutes a promise that a particular service is suitable for you or that a particular result will be achieved.
You should obtain appropriate professional advice before acting on information that may materially affect your legal rights, finances, family relationships, religious obligations, or other important interests.

Eligibility and Authority
By using the website or entering into an arrangement with Darul Islah, you represent that:
• you are legally capable of entering into the relevant arrangement; and
• the information you provide is accurate to the best of your knowledge.
Where a service involves a minor or another person lacking contractual capacity, the relevant consent, representation, or participation shall be handled in accordance with applicable law and the requirements of the particular service.
If you act on behalf of another person, organisation, family member, or entity, you represent that you have the authority to do so.

Registration and Case Submission
Where the website permits case registration or online submission, the information provided will be used for the purpose of evaluating or processing the request in accordance with the applicable service framework and Privacy Policy.
Submission of a case does not guarantee acceptance, appointment of a professional, commencement of proceedings, or provision of any particular service.
Darul Islah may decline a request where the matter is unsuitable, outside our scope, affected by a conflict, legally or professionally inappropriate, insufficiently documented, or otherwise unsuitable for acceptance.

Service-Specific Agreements
Certain services may require additional terms or documents before commencement, including:
• engagement letters or retainers;
• quotations or fee confirmations;
• mediation agreements;
• arbitration agreements;
• consent forms;
• settlement terms;
• documentation mandates; or
• other service-specific agreements.
Where such documents are executed or accepted, they shall govern the relevant service in addition to these Terms.
In the event of inconsistency, the specific service agreement shall prevail over these general Terms to the extent of that inconsistency.

Fees and Payments
All service charges, professional fees, consultation charges, documentation charges, administrative charges, and other applicable payments shall be communicated through the applicable fee schedule, quotation, invoice, service page, engagement document, or other written communication.
Unless expressly stated otherwise, applicable taxes, statutory charges, court fees, filing fees, stamp duty, registration charges, third-party professional charges, travel expenses, and similar external costs may be payable separately.
A payment made for a specific service is a service payment and not a donation.
Voluntary donations are separate from service payments and are governed by their stated purpose.

Payment Authorisation
When you make a payment through the website or an authorised payment channel, you confirm that:
• the payment information provided is accurate;
• you are authorised to use the relevant payment method; and
• you authorise the applicable payment provider to process the transaction.
Darul Islah is not responsible for technical failures attributable solely to a bank, payment gateway, card issuer, telecommunications provider, or other third-party payment service.

Refund and Cancellation Policy
Refund eligibility depends on the nature and stage of the service.

Before Service Commencement
Where a service has not commenced and no substantive work has been undertaken, a refund may generally be considered upon cancellation, subject to any clearly disclosed non-refundable transaction, booking, administrative, statutory, or third-party charges.

After Service Commencement
Once a service has commenced, any refund will ordinarily be assessed with reference to the work already performed, time or sessions already provided, documents already prepared, professional commitments already made, and non-refundable third-party expenses incurred.
Fees corresponding to services already rendered or work already completed are ordinarily non-refundable.

Counselling, Consultation and Appointments
For appointments or sessions, cancellation or rescheduling may be subject to the applicable notice period communicated at the time of booking. A missed appointment without adequate notice may be treated as a utilised session where the applicable service arrangement so provides.

Mediation and Arbitration
Refunds relating to mediation or arbitration may be affected by the stage of the proceedings, professional time already incurred, tribunal or mediator fees, venue or administrative expenses, and the terms of the applicable mediation or arbitration agreement.
Where an arbitration agreement or tribunal order governs payment, that arrangement will prevail.

Legal Services
Professional fees paid for legal work already performed, documents prepared, conferences conducted, appearances made, or other professional services rendered are generally not refundable merely because the client later changes their instructions, discontinues the matter, or is dissatisfied with the outcome, subject always to applicable law and professional obligations.

Refund Processing
Where a refund is approved, it will ordinarily be made through the original payment method or another lawful method agreed with the payer, subject to applicable banking and payment-processing requirements.
The time required for the refund to reach the payer may depend upon the payment gateway, bank, card issuer, or other payment intermediary.

No Waiver of Statutory Rights
Nothing in this refund policy is intended to exclude or restrict any refund, remedy, or consumer right that cannot lawfully be excluded or restricted under applicable law. The Consumer Protection Act, 2019 addresses unfair contracts and provides remedies against contractual terms that are unfair to consumers.

Donations
Donations are voluntary contributions made to support the broader objectives and activities of Darul Islah.
A donation does not create an entitlement to any particular professional service, result, priority, appointment, representation, Fatwa, mediation, arbitration, or other benefit unless expressly stated otherwise.
Donations are distinct from mandatory service payments.

Intellectual Property
Unless otherwise stated, the website, its design, layout, text, graphics, logos, photographs, videos, illustrations, documents, forms, branding, and other original content are owned by or lawfully licensed to Darul Islah or LegalLords LLP and are protected by applicable intellectual-property laws.
The Copyright Act, 1957 provides the statutory framework for copyright protection in India.
You may access and use website content for lawful personal or internal informational purposes. You may not, without prior written permission:
• reproduce substantial portions of the website;
• republish or commercially exploit our content;
• alter or create derivative versions of protected material;
• use our name, logo, or branding in a misleading manner;
• remove copyright, trademark, or proprietary notices; or
• represent our material as your own.

User-Submitted Material
Where you submit information, documents, text, images, or other material through the website, you represent that you are authorised to provide it and that doing so does not knowingly violate another person's lawful rights.
You retain ownership of material that you lawfully own. You grant Darul Islah the limited rights necessary to receive, review, process, store, communicate, and use the submitted material for the purpose for which it was provided and as otherwise permitted or required by law.
The handling of personal data is governed separately by our Privacy Policy.

Prohibited Use
You must not use the website or our services:
• for any unlawful, fraudulent, deceptive, or malicious purpose;
• to impersonate another person or misrepresent your authority;
• to submit knowingly false or fabricated information;
• to interfere with the website or its security;
• to introduce malicious code or attempt unauthorised access;
• to misuse another person's confidential information;
• to harass, threaten, intimidate, or abuse our staff or professionals; or
• to use our services for any purpose prohibited by law or applicable professional standards.
We may suspend or restrict website access where reasonably necessary to protect the website, our users, our professionals, or our legal and operational interests.

Third-Party Services and Links
The website may contain links to third-party websites, payment gateways, software, platforms, professional resources, or other services.
Such third parties operate independently and may have their own terms and policies. Unless expressly stated otherwise, Darul Islah does not control and is not responsible for the content, security, availability, accuracy, or practices of third-party websites or services.
A link does not necessarily constitute an endorsement.

External Communications and Electronic Systems
We may use email, telephone, messaging services, online meeting platforms, electronic signatures, payment gateways, document-management systems, and other third-party technology in delivering services.
Electronic communication can be subject to technical interruption, delay, interception, delivery failure, malware, or other risks. While reasonable safeguards may be used, no electronic communication system can be guaranteed to be completely secure or continuously available.
The legal recognition of electronic records and electronically formed contracts is governed by applicable law, including the Information Technology Act, 2000.

No Guarantee of Outcome
Darul Islah does not guarantee:
• that a dispute will be settled;
• that reconciliation will succeed;
• that a party will accept a proposed settlement;
• that an arbitrator, court, tribunal, authority, or other decision-maker will decide a matter in a particular manner;
• that legal proceedings will produce a particular result;
• that a personal, marital, family, financial, psychological, or religious outcome will occur; or
• that a Fatwa or religious opinion will be accepted by every person or authority.
Any statements regarding possible outcomes are expressions of professional opinion or general expectations and should not be understood as guarantees.

Legal, Psychological and Religious Disclaimers
Information provided through the website is not a substitute for individual professional assessment.
Indian legal advice is provided by qualified advocates within the scope of their professional engagement.
Psychological or counselling services are provided by appropriately qualified professionals within the scope of their qualifications and applicable professional standards.
Islamic guidance and Fatwa are provided by qualified Islamic scholars and Muftis and represent religious or jurisprudential guidance. A Fatwa is not, merely by being issued, an order or judgment of an Indian court or statutory authority.
Where a matter involves both Indian law and Islamic jurisprudence, the applicable legal and religious advice should be considered separately and, where appropriate, together.

Limitation of Liability
To the maximum extent permitted by applicable law, Darul Islah and LegalLords LLP shall not be liable for indirect, incidental, special, consequential, or purely economic losses arising solely from use of the website or from matters outside the agreed scope of a service.
Nothing in these Terms excludes or restricts liability that cannot lawfully be excluded or restricted, including any liability that applicable law requires to remain enforceable.
Nothing in these Terms is intended to prevent a client or consumer from exercising a statutory right or remedy available under applicable law.

Accuracy of Client Information
You remain responsible for the accuracy and completeness of information you provide through the website or in connection with a service.
We may rely upon information and documents provided by you unless circumstances reasonably indicate that they require clarification or verification.
Material omissions, inaccurate information, fabricated documents, or misleading statements may affect our ability to provide the service and may result in suspension or termination of the engagement, subject to applicable law and professional obligations.
Detailed responsibilities relating to the handling of matters are set out on our "How We Work" page.

Indemnity
To the extent permitted by law, you agree to indemnify Darul Islah and LegalLords LLP against losses, claims, liabilities, costs, or expenses arising directly from your unlawful use of the website, fraud, wilful misconduct, unauthorised use of another person's information, or material breach of these Terms.
This provision does not require you to indemnify us for losses caused by our own conduct to the extent that such indemnification would be prohibited by applicable law.

Suspension and Termination
We may suspend or terminate your access to the website or relevant digital functionality where necessary because of:
• breach of these Terms;
• unlawful or abusive conduct;
• security concerns;
• misuse of the website;
• fraudulent activity;
• technical or operational necessity; or
• legal or regulatory requirements.
Termination of website access does not automatically terminate an existing professional engagement, which shall instead be governed by the applicable service agreement, professional obligations, and the How We Work framework.

Changes to These Terms
We may update these Terms from time to time to reflect changes in law, services, technology, business practices, or operational requirements.
The revised version will be published on this page with an updated effective date where appropriate.
Where a change materially affects an existing contractual relationship and applicable law requires further notice or consent, the relevant legal requirements will be followed.

Governing Law
These Terms shall be governed by and construed in accordance with the laws of India, except to the extent that mandatory applicable law requires otherwise.
Nothing in these Terms prevents the application of mandatory statutory rights, consumer remedies, professional regulations, or other laws that cannot lawfully be excluded by agreement.

Dispute Resolution
Any dispute, claim, controversy, or disagreement arising out of or relating to these Terms, the website, any service, payment, transaction, or agreement between the parties shall, before commencement of formal legal proceedings, be referred to and finally resolved by arbitration, to the fullest extent permitted by law. The parties shall endeavour to mutually appoint a sole arbitrator and, failing such agreement or appointment within the applicable period, the arbitrator shall be appointed in accordance with the Arbitration and Conciliation Act, 1996. The seat and legal place of arbitration shall be within NCT of Delhi, and the arbitration shall be conducted in accordance with applicable law, ordinarily in English.
Nothing herein shall prevent a party from approaching a competent court for relief that cannot legally be granted by an arbitral tribunal or for any proceeding expressly permitted or required by law, including appointment of an arbitrator, interim measures, setting aside, or enforcement of an arbitral award. Any such proceeding shall, subject to applicable law, be brought before the competent courts situated within NCT of Delhi having jurisdiction.
Acceptance of these Terms electronically shall constitute acceptance of this arbitration agreement to the extent recognised by applicable law.

Jurisdiction
These Terms of Use and all matters arising out of or relating to the use of the Darul Islah website, services, payments, transactions, or any agreement between the parties shall be governed by the laws of India. Subject to the arbitration mechanism below and matters for which court intervention is legally required or permitted, the competent courts situated within the National Capital Territory of Delhi having jurisdiction over the relevant cause of action and the parties shall have jurisdiction over such matters. Nothing in these Terms shall confer jurisdiction on a court that otherwise lacks jurisdiction under applicable law.

Severability
If any provision of these Terms is held to be unlawful, invalid, or unenforceable by a competent authority, that provision shall be enforced to the maximum extent legally permissible and the remaining provisions shall continue to operate to the extent permitted by law.

No Waiver
Failure or delay by Darul Islah in enforcing any provision of these Terms shall not constitute a waiver of that provision or our right to enforce it later.
A waiver must be expressly made to be effective.

Entire Agreement
These Terms, together with the applicable "How We Work" page, Privacy Policy, service-specific agreements, quotations, engagement letters, consent documents, and other expressly incorporated documents, constitute the applicable contractual framework between you and Darul Islah in relation to the relevant website use or service, subject to the nature of the arrangement and applicable law.
Where a specific service agreement applies, its provisions shall govern the service to the extent stated therein.
